If the driving license authority believes that the conditions for revoking a driver's license are met—for example, due to alcohol or drug consumption or repeated violations of road traffic regulations—it issues an administrative order in the form of a "revocation of a driver's license." This often involves ordering "immediate enforcement," which directly restricts the rights of the person concerned.
Normally, a citizen has the right to lodge an objection against burdensome administrative acts. This objection would have a suspensive effect, meaning that the administrative act may not be executed for the time being. However, if immediate execution is ordered, this suspensive effect is lost. Instead, the affected person only has the option of filing an urgent application for interim legal protection pursuant to Section 80 Paragraph 5 of the Administrative Court Act (VwGO). Such an application is generally processed promptly by the administrative courts, as it involves acute interference with the rights of the affected person.
